How Does Bankruptcy Eliminate Debts?

In general, a debtor will automatically receive a discharge unless someone files an objection to it. According to the Federal Rules of Bankruptcy Procedure, the bankruptcy court clerk will send copies of the order of discharge to all creditors, including their respective attorneys, if applicable, the U.S. Trustee, and all trustees in the case. The debtor and their bankruptcy attorney will receive a copy of the discharge order.

The notice does not mention which debts the court has ruled are non-dischargeable and, therefore, still owed. The notice only informs creditors that the debtor no longer owes them any money and that they should not try to collect payment.

The notice cautions that anyone continuing collection efforts could be subject to punishment. If the clerk fails to send a copy of the discharge order within the required time, it does not affect whether or not the debtor gets their discharge.
